Powers and Duties of Local Councils
Local Councils have a wide range of powers and duties. The following table sets out the main ones; it is not a complete list of every single power and duty.
General Power of Competence
The Localism Act 2011 Sections 1-8 granted to a qualifying Parish or Town Council the power to do anything that individuals may generally do.
The previous Power of Well-Being no longer exists for new projects and the arrangements for managing the transition and is available to member councils.
The power enables a Parish or Town Council to be innovative and to better meet the needs to local people and is referred to as the power of ‘first resort’.
The to be eligible to use the power a Parish or Town Council must have an appropriately qualified Clerk and at least two thirds of the Councillors must have been elected. Full details of the power are available to members through the members site.
